Terms and Conditions

Effective and last updated October 25, 2026

These terms are the agreement between you and MK Development about Kaizen: our website (my-kaizen.com), our web app (my-kaizen.app), and our apps for iPhone, iPad, Android, and Windows (together, "Kaizen"). They apply when you create a Kaizen account or buy Premium, and you agree to them when you do. The apps and the web app are also licensed to you under our End User License Agreement (EULA). How we handle personal data is explained in our Privacy Policy, which is not part of this agreement. You can save or print this page.

The short version

  • Kaizen is run by MK Development, a one-person business in the Netherlands.
  • You can use Kaizen from age 13. If you are under 18, you need a parent's or guardian's permission.
  • Kaizen is free. Premium is a paid subscription that renews automatically until you cancel it where you bought it.
  • If you buy Premium on the web or in the Windows app, you can withdraw within 14 days and get a full refund. If your plan starts with a free trial, the 14 days run from the day the trial starts, not from the first charge. App Store and Google Play purchases follow those stores' rules.
  • What you create stays yours. We use it only to run Kaizen for you.
  • Be decent: no harassment, illegal content, or offensive names. We filter offensive words, act on reports, and tell you why if we take action against you.
  • Your rights under consumer law always apply. Dutch law governs these terms, and you keep the protection of the consumer law where you live.

Who we are

Kaizen is run by MK Development, a sole proprietorship (eenmanszaak) owned by Max Kruiswegt, at Westerparkstraat 2U, 2042 AW Zandvoort, the Netherlands. Chamber of Commerce (KvK) number 89767810, VAT number NL004755047B80. Phone +31 6 82945309. Email info@my-kaizen.com for questions, complaints, and legal matters, or support@my-kaizen.com for help with the app. In these terms, "we", "us", and "our" mean MK Development, and "you" means the person using Kaizen.

Who can use Kaizen

  • Kaizen is for people aged 13 and over. If you are under 18, you need permission from a parent or guardian to use it.
  • You need a Kaizen account to use the apps. Give accurate details when you sign up, and keep them up to date.
  • An account is for one person. You can use Kaizen for study, work, or your personal life, but you may not sell or rent access to Kaizen or use it to build a competing service.
  • You may not use Kaizen where the law forbids us from providing it to you, for example because of sanctions.

Your account

You can create an account with your email address, a username, and a password, or sign in with Google, Apple, or Discord. If you sign in with one of those, its own terms also apply to that account, and our Privacy Policy explains what we receive from it.

Keep your login details to yourself. If you think someone else has access to your account, change your password and tell us at support@my-kaizen.com.

Your username must follow the rules for using Kaizen. We can change a username that breaks those rules or pretends to be someone else, and we tell you why.

You can delete your account at any time: open Settings from your profile, go to Account, and choose to delete it, or email support@my-kaizen.com from the address on your account. We keep it for 30 days in case you change your mind, and then delete it permanently, apart from the records our Privacy Policy describes. Deleting your account does not cancel your subscription, so cancel that first. Our Privacy Policy explains what happens when you delete your account. To get a copy of your data, email info@my-kaizen.com.

What Kaizen does

Kaizen is a focus app. It has a Pomodoro timer and a stopwatch, tasks, habits, focus statistics, music and timer backgrounds, reminders, Focus Rooms where you study alongside other people, and, in the iPhone, iPad, and Android apps, app blocking. Your data syncs across your devices when you sign in. Some features need an internet connection, such as signing in, syncing, joining a Focus Room, and buying Premium.

A few things to know:

  • Timers and reminders depend on your device and its operating system, for example how it handles apps in the background and delivers notifications. From version 5.1 of the app, closing the app usually does not end a running session: when you open it again on the same device within 24 hours, the session carries on, or counts as finished if its time ran out.
  • Statistics are based on how you use the app. They are not meant for official time tracking, billing, or proving your working hours.
  • Results. Kaizen helps you focus, but we cannot promise that it will make you more productive or help you reach a particular goal.
  • Not advice. Kaizen is not medical, psychological, or other professional advice. If you have concerns about your attention or mental health, talk to a qualified professional.

None of this affects your legal rights if Kaizen does not work as agreed. See Availability and updates.

App blocking

App blocking works only in the iPhone, iPad, and Android apps. It relies on features of your device that you control: Apple's Screen Time on iPhone and iPad, and the usage access and display over other apps permissions on Android. You can switch those features off in your device's settings. On Android, some apps, such as your phone's dialer, emergency information, and Settings, can never be blocked. Depending on the settings you choose, you can also open a blocked app anyway. App blocking is there to help you focus. It is not a security or parental-control tool, so do not rely on it where your safety or someone else's depends on it.

Free and Premium

You can use Kaizen for free, with some limits. Premium removes those limits and adds features. The app and our pricing page show what is included in each.

When Premium ends, nothing you created is deleted. Anything over the free limits stays, but you cannot add more until you are under them again, and statistics older than 30 days are hidden until you have Premium again. For app blocking, your whole list stays, but only 3 apps are blocked (on iPhone and iPad, apps and websites together), and the Strict and Locked levels work like Normal until you have Premium again. All your block schedules stay too, but only the oldest one can run, as Normal and with 3 of its apps (on iPhone and iPad, apps and websites together), until you have Premium again. Ending Premium does not remove the Premium avatar parts you wear, such as gestures, shirt prints, and gradients, but once you change one, putting it back needs Premium again.

Buying Premium

Where you buy it

  • In the App Store or Google Play. You pay Apple or Google, and they handle payment, renewals, and cancellation under their own terms. Apple decides on refunds for App Store purchases, so ask Apple; we cannot issue those ourselves. For Google Play purchases, you can ask Google Play or us. Your rights under consumer law still apply to these purchases; see Availability and updates.
  • On the web or in the Windows app. We sell you the subscription. You pay through RevenueCat's checkout, and card payments are processed by Stripe.

Prices are shown before you buy and include VAT where it applies. The App Store and Google Play set their prices per country.

How buying on the web works

On the web and in the Windows app, you choose a plan on Kaizen's Premium screen and continue to our checkout. There you see the price and enter your payment details. Before you pay, you can check your choices and go back to change them. Your purchase is complete when you confirm the payment, and we send you a confirmation by email. We keep a record of your purchase, which you can ask for at support@my-kaizen.com, and these terms stay available on this page, where you can save or print them. These terms are available in English only, even if you use Kaizen or our checkout in another language. We have not signed up to any code of conduct.

Free trials

Some plans start with a free trial. Before you start, the app shows how long it lasts and what you will pay after. When the trial ends, it turns into the paid plan you chose, at that price, unless you cancel before the trial ends. If you cancel during the trial, you are not charged. In the App Store, cancel at least 24 hours before the trial ends. Whether you can get a trial is decided by the App Store, Google Play, or our checkout; trials are usually for new subscribers.

Renewal and canceling

Premium renews automatically at the end of each billing period, monthly or yearly, until you cancel it. A yearly plan renews for another year. If you live in Quebec, this does not apply to you: a renewed plan continues month to month and you can cancel it at any time.

To cancel:

  • App Store: in your Apple account's subscription settings, at least 24 hours before the current period ends.
  • Google Play: in Google Play's subscription settings.
  • Web or Windows app: in Kaizen, under Settings, then Account, then Manage Subscription, or by emailing support@my-kaizen.com.

When you cancel, your subscription stops renewing and you keep Premium until the end of the period you paid for. If consumer law that applies to you lets you end a renewed plan sooner, you keep that right, and we refund the unused part as that law requires.

Price changes

If we change the price of a web or Windows subscription, for example because our costs, taxes, or what Premium includes change, we email you 30 days before the new price first applies to you, with instructions for canceling. The new price applies from your next billing period after that, and you can cancel before then if you do not want to pay it. We never raise your price in the first 3 months of your subscription. For App Store and Google Play subscriptions, Apple or Google tells you about a price change and asks for your agreement where their rules require it.

Refunds and your right to withdraw

These rules apply to Premium bought on the web or in the Windows app. For the App Store and Google Play, see Where you buy it.

Your 14-day right to withdraw. Wherever you live, you can withdraw within 14 days of subscribing without giving a reason, and we refund what you paid in full. The 14 days start the day after you buy Premium, or the day after your free trial starts if your plan begins with one. There is no new 14-day period when a trial turns into a paid plan or when a plan renews.

The easiest way to withdraw is to email support@my-kaizen.com with your name, your account's email address, and that you withdraw from your Premium subscription. You can use the model form below, but you do not have to. We confirm your withdrawal by email and refund you within 14 days, to the payment method you used, at no cost to you. Your Premium ends when we refund you.

Other refunds. We also refund the unused part of your payment if:

  • Kaizen does not work as agreed and we cannot fix it, in which case we also refund what you paid for the time it did not work (see Availability and updates)
  • a change makes Premium worse for you in more than a minor way and you end your subscription within 30 days (see Changes to Kaizen)
  • we stop offering Kaizen or Premium before the end of the period you paid for, or close your account for a reason that is not your fault
  • we have to remove a Premium feature during a period you paid for and you end your subscription (see Changes to Kaizen)
  • you end your subscription because of a change to these terms, or because we transfer this agreement to someone else (see Changes to these terms and Other legal terms)

Apart from these cases and your rights under consumer law, canceling stops future payments but does not refund the current period.

Focus Rooms

A Focus Room holds 2 to 50 people, each using their own timer. Anyone signed in to Kaizen can find and join a public room, and anyone with its code can join a private room. Joining is free, and so is hosting a private room for up to 4 people. Public rooms, and rooms for more than 4, need Premium. Our Privacy Policy explains what other members can see. There is no chat, audio, or video.

You are removed from a room automatically if Kaizen stops checking in for 15 minutes, for example because it is closed, offline, or in the background on your phone, if the host removes you, or if you join another room on another device. You can join again afterward. The host can rename the room, change who can join and how many people fit, remove members, and hand over hosting. When the host leaves, hosting passes to another member, and a room closes when its last member leaves. Hosts are responsible for their room's name, which must follow the rules for using Kaizen.

Your content

Your content is what you add to Kaizen. Most of it, such as your tasks, habits, and sessions, is private to your account. A few things are shown to other people, such as your username and avatar, the names of rooms you create, your status, timer, focus tag, and time in a room, whether you host it, and, if you have Premium and turn on task sharing, the title of your active task.

You keep all rights to your content. You give us a worldwide, non-exclusive, royalty-free license to store, copy, process, and show it, but only as far as we need to run Kaizen for you and the people you use it with. For example, we sync your tasks across your devices and show your username and avatar to members of a room you join. This includes technical changes, such as hiding offensive words, and our service providers may do the same on our behalf. The license ends when you delete the content or your account, except for copies we still hold as our Privacy Policy describes.

Only add content you have the right to use.

Feedback. If you send us ideas or feedback, you keep your rights to what you wrote. You give us a free, non-exclusive, worldwide, permanent license to use it to improve Kaizen, without paying or crediting you. Personal data in your message is handled as our Privacy Policy describes.

Rules for using Kaizen

Your username, room names, and anything you share in a room must not:

  • break the law or infringe someone else's rights, such as copyright or privacy
  • harass, threaten, or bully anyone, or attack people for who they are
  • be sexual, violent, or shocking, or sexualize minors in any way
  • support terrorism or violent extremism
  • pretend to be someone else, including us
  • advertise or spam
  • include someone else's personal information without their permission

When you use Kaizen, you must not:

  • harass or threaten other users, or disrupt their Focus Rooms
  • create fake accounts, or a new account to get around a suspension
  • share, sell, or rent your account or Premium, except through a store's family sharing where it is available for Kaizen
  • abuse the referral program, for example by creating accounts to earn points
  • use bots, scripts, or scrapers to access Kaizen, collect information about other users, or put an unreasonable load on our systems
  • get around Premium limits, security measures, or other technical limits
  • reverse engineer the apps, except where the law allows it
  • use Kaizen for anything illegal

Referral points

Everyone has a referral code. When someone enters your code in the app, you earn points, and you earn more the first time they start Premium, including a free trial. You can swap points for Premium time in the app.

Points have no cash value and cannot be sold, transferred, or exchanged for money. We can change the rewards or end the program. If a change makes your points worth less, or we end the program, we tell you at least 30 days in advance so you can use your points first. We can remove points earned through fake or duplicate accounts, or by referring yourself.

How we moderate

We use a few automated checks. Room names are checked against a list of offensive words when a room is created or renamed, and names that match are refused. Usernames are checked the same way when you change them in your profile. Offensive words in a task title you share in a room are hidden from other members automatically. These checks run without a person looking at them.

Reports are reviewed by a person. We do not monitor everything people add to Kaizen, but we act on reports and on what we come across. A room's host can also rename the room, change who can join, and remove members, who can join again later.

What we can do. We can remove or hide content, change a username or room name, remove someone from a room, or suspend or close an account. We do this if content or behavior breaks these terms or the law, if the law requires it, or to protect other people or Kaizen from serious harm, and we act in proportion to what happened.

Telling you why. When we remove or hide your content, change your username or room name, remove you from a room, or suspend or close your account, we email you what we did and why, whether it followed a report, which rule or law it concerns, whether an automated tool was involved, and how to challenge it, unless the law stops us. The automatic checks work on the spot: the app tells you when a room name or username is refused, and offensive words in a shared task title are hidden as described above, and you can see the masked version yourself in the room's member list. If you think an automatic check got it wrong, email info@my-kaizen.com and a person will look at it. You can reply to any decision to contest it, and we will look at it again. You can always go to court as well.

Serious harm and terrorist content. We report suspected crimes that threaten someone's life or safety to the authorities, as the law requires. We do not allow terrorist content: we remove it, or block access to it, as soon as we become aware of it, and within one hour of a removal order from an authority. We do not use automated tools built specifically to detect terrorist content.

Reporting content

To report content or behavior you think is illegal or against these terms, including a copyright complaint, email info@my-kaizen.com with:

  • the username or room name and where you saw it (a screenshot helps)
  • why you think it is illegal or against these terms
  • your name and email address (if you report child sexual abuse material, you may leave out your name and write from any email address)
  • a statement that your report is accurate and complete to the best of your knowledge

We confirm that we received your report, decide carefully and without undue delay, and tell you what we decided and how to challenge it. We may tell the person involved that we received a report, but we do not share your name or contact details with them unless you agree or the law requires it.

Our rights in Kaizen

We own Kaizen, or license it from others: the apps, the website, the design, the text, the music and backgrounds, and the Kaizen name and logo. The music and backgrounds are ours or licensed to us by their creators, so you may use them only inside Kaizen. We give you a personal, non-exclusive, non-transferable right to use Kaizen as these terms allow. Please do not use our name or logo in a way that suggests we endorse you without asking us first.

Your license to the app software, including the web app, is set out in our EULA. If the EULA and these terms ever conflict, the EULA applies to your license to use the app software, and these terms apply to everything else.

Changes to Kaizen

We keep improving Kaizen, so features change. We may change or remove a feature to fix problems, improve the app, keep it secure, follow the law or app store rules, or because a provider we rely on changes or stops its service. Changes never cost you extra.

We do not remove Premium features during a billing period you have already paid for. If the law or a provider we rely on ever forces us to, we tell you, and you can end your subscription and get the unused part of a web or Windows payment back. If a change makes Premium worse for you in more than a minor way, we email you in advance, telling you what changes, when, and that you can end your subscription. If you pay on the web or in the Windows app, you can then end it within 30 days of the change and get the unused part of your payment back. For App Store and Google Play subscriptions, you can cancel with the store. For Google Play, you can also ask Google Play or us to refund the unused part.

Changes to these terms

We may update these terms only when Kaizen's features, our prices, the services we rely on, or the law change, or to make them clearer or fix mistakes. If a change matters to you, we tell you in the app or by email 30 days before it applies. If you do not agree, you can stop using Kaizen, delete your account, and cancel your subscription before the change applies. If you pay on the web or in the Windows app and end your subscription for this reason, we refund the unused part. If you keep using Kaizen after the change applies, the new terms apply to you. Changes that only fix mistakes or make the text clearer apply when we post them, and changes the law requires apply from the date the law sets. If you live in Quebec, we email you about any change that affects your rights or obligations at least 30 days before it applies, showing the old and new wording and the date it takes effect, and you can refuse it and cancel your subscription at no cost.

Availability and updates

Your legal guarantee. Kaizen must work as described and as you may reasonably expect, and you get the updates needed to keep it working and secure for as long as we provide it to you. If it does not, tell us at support@my-kaizen.com and we will fix it. If we cannot, you may be entitled to a price reduction or to end your subscription with a refund. Nothing in these terms limits these rights.

We work to keep Kaizen available and accurate, but we cannot promise that it will always be available or free of errors. Maintenance, short outages, and small timing differences can happen. We back up our servers regularly, but no backup is perfect, so keeping your own copy of anything important is a good idea. Each store listing shows which devices and system versions Kaizen supports. To keep Kaizen working and secure, we may stop supporting older devices, system versions, and versions of the apps and the web app. From version 5.0 of the app, if you use a version we no longer support, Kaizen asks you to update it when you open it, before you can keep using it; an earlier version may simply stop working. If your device cannot run a version we still support, you can still use Kaizen in a current browser at my-kaizen.app, and your legal guarantee above still applies.

Suspension and ending this agreement

You can stop using Kaizen at any time. To end this agreement, delete your account and cancel your subscription.

We can suspend or close your account if you seriously or repeatedly break these terms or the law, if the law requires it, or to protect other people or Kaizen from serious harm. Where we can, we tell you first and give you a chance to fix the problem, and we tell you why, as described under How we moderate. If we close your account because you broke these terms, you may not create a new one to get around that. If we close your account for a reason that is not your fault, we refund the unused part of a web or Windows subscription.

If we stop offering Kaizen or Premium, we tell you at least 30 days in advance and stop all subscriptions from renewing. You keep Premium until the end of the period you paid for. If we cannot provide it that long, we refund the unused part of a web or Windows subscription. Refunds for App Store subscriptions go through Apple, and for Google Play subscriptions through Google Play or us. Before your account closes, you can ask for a copy of your data at info@my-kaizen.com.

Liability

Your consumer rights

Some rights cannot be taken away by a contract, such as the legal guarantee for digital content and services in the European Union and the United Kingdom, and the consumer guarantees under the Australian Consumer Law. Nothing in these terms limits them.

If you live in Australia. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service. To claim under our promises in these terms, email support@my-kaizen.com. You can claim at any time while we provide Kaizen to you, which is how long our promises last. Our promises are given by MK Development, Westerparkstraat 2U, 2042 AW Zandvoort, the Netherlands, phone +31 6 82945309, email support@my-kaizen.com. Claiming costs you nothing: we bear our own costs of fixing the problem or refunding you, and if claiming ever costs you something, email us and we will pay it back. The benefits of our promises in these terms are in addition to these rights and your other rights under the law.

Our liability

We are fully liable for damage we cause on purpose or through gross negligence, for death or personal injury we cause, and for anything else the law does not let us limit.

If you live in Quebec, the limits in the rest of this section do not apply to you. Otherwise:

  • we are only liable for damage that was reasonably foreseeable when it was caused, and
  • our total liability to you is limited to the higher of 100 euros or what you paid for Kaizen Premium in the 12 months before the damage happened.

We are not liable for delays or failures caused by events outside our reasonable control, such as a widespread internet, power, or app store outage. None of this affects your legal guarantee or your other rights under consumer law.

Your liability

If you break these terms or the law and someone holds us responsible because of it, you are responsible for that damage as far as the law makes you liable for it.

Kaizen works with services run by others, such as the App Store, Google Play, the Microsoft Store, Google, Apple, and Discord sign-in, and our payment providers. Their own terms apply to how you use them. Links to other websites lead to pages we do not control, and their own terms and policies apply there.

Disputes and which law applies

If something goes wrong, please email info@my-kaizen.com first so we can try to solve it together. This never stops you from going to court.

Dutch law applies to these terms. If you use Kaizen as a consumer, you also keep the protection of the mandatory consumer laws of the place where you live, and nothing in these terms takes that away. You can take a dispute to the competent court in the Netherlands or, where your local law allows it, to the courts where you live. If you are a consumer, we can only take you to court in the country where you live.

  • These terms, together with the EULA, are the whole agreement between you and us about Kaizen. Our Privacy Policy explains how we handle personal data and is not part of this agreement.
  • If a court decides that part of these terms is invalid, the rest still applies.
  • If we do not enforce a right straight away, we do not give it up.
  • We may transfer this agreement to someone who takes over Kaizen. We will tell you, and you can end it if you do not want to continue with them; if you pay on the web or in the Windows app, we then refund the unused part. You may not transfer your account or this agreement to someone else.
  • We communicate with you electronically, by email and in the app, and, where the law allows, that counts as in writing.
